These Terms & Conditions (“Terms”) govern your access to and use of the website operated by S W Hart Enterprises LLC, doing business as Wave Development Partners (“we,” “us,” “our”). By using the Site, you agree to these Terms — including the SMS / Text Messaging Program terms in Section 13 — and to our Privacy Policy. If you do not agree, do not use the Site.
The Site provides general information about Wave Development Partners and the luxury developments we market in Costa Rica. Nothing on the Site is an offer to sell or a solicitation of an offer to buy any property, security, or investment, and nothing constitutes real-estate, legal, tax, financial, or investment advice. Any property information, imagery, pricing, availability, and features are illustrative, may be provided by third parties, and are subject to change or withdrawal without notice. You should independently verify all information and engage your own licensed professionals and attorney before making any decision.
Wave Development Partners provides marketing and advisory services and facilitates introductions to developers and to independent, vetted real-estate agents. We are not a party to, and are not responsible for, any transaction between you and a developer or agent. Real-estate brokerage services, where applicable, are performed by appropriately licensed parties.
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Site.
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping or harvesting data, transmitting malware, or using it for any unlawful purpose or in violation of these Terms.
Information you submit through the Site must be accurate and your own to share. By submitting, you grant us permission to use it to respond to and manage your inquiry, as described in our Privacy Policy.
The Site and its content — including text, design, logos, and the “Wave Development Partners” name and marks — are owned by us or our licensors and are protected by intellectual-property laws. You may not copy, reproduce, or create derivative works without our prior written permission, except for personal, non-commercial viewing.
The Site may link to third-party websites and services we do not control. We are not responsible for their content, policies, or practices. Access them at your own risk.
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, we and our affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You agree to indemnify and hold us harmless from claims and expenses arising out of your misuse of the Site or breach of these Terms.
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-laws rules. Disputes will be subject to the exclusive jurisdiction of the courts of the state and federal courts located in Utah County, Utah, except where mandatory local consumer-protection law provides otherwise.
This section governs the text-messaging program (“Program”) offered by S W Hart Enterprises LLC, doing business as Wave Development Partners. By providing your mobile number and checking an SMS consent box on our inquiry form, you agree to these SMS terms. SMS consent is collected through two separate, unchecked checkboxes — one for transactional messages and one for marketing messages — and neither is required to submit the form or to do business with us.
When you opt in, you will receive text messages (SMS/MMS) from Wave Development Partners related to your inquiry — advisor replies and conversations, project and availability updates, and appointment scheduling and reminders — and, if you check the marketing box, occasional promotional messages about our developments.
Message frequency varies based on your interaction with us. Message and data rates may apply from your mobile carrier; we do not charge for the messages themselves.
You can cancel at any time by replying STOP to any message. We will send one confirmation message and then stop texting, unless you opt in again.

Your agreement to receive text messages is not required to engage Wave Development Partners or to use any service. You can work with us by email or phone if you prefer not to receive texts.
Supported carriers include major US mobile carriers. Carriers are not liable for delayed or undelivered messages, and delivery is not guaranteed. You represent that you are the account holder or an authorized user of the mobile number you provide and are at least 18 years old. If your number changes, notify us and opt out so messages do not reach an unintended recipient.
No mobile information (including your phone number and SMS consent) will be shared with third parties or affiliates for their own marketing or promotional purposes. We share mobile information only with vendors that help us operate the Program (such as our messaging platform, CRM, and workflow automation), strictly to deliver the service on our behalf. Text-messaging opt-in data and consent are never sold, rented, or shared with third parties for their marketing. See our Privacy Policy for full details.
We may update these Terms from time to time. The updated version is effective when posted with a new “Last updated” date. Your continued use of the Site constitutes acceptance.
